Scope and Types of Abuse
As BNET Bulut Bilişim LTD. ŞTİ. (hereinafter referred to as “BurtiNET”), we apply this Abuse Policy to prevent the misuse of our services and to protect the rights of third parties. This policy is to be read together with the Terms of Service and the Acceptable Use Policy.
Abuse refers to the following types of violations hosted on BurtiNET infrastructure or carried out through BurtiNET services:
- Spam and bulk e-mail: Sending unsolicited, bulk or commercial advertising e-mail; use for mailing/newsletter purposes (outside the permitted scope).
- Malicious software and security breaches: Malware, viruses, ransomware, phishing or identity-theft sites; unauthorized access tools; being the source of DDoS attacks or scanning; botnets or command-and-control servers.
- Illegal content: Content that violates the laws of Turkey or of the relevant country; fraud, hate speech, violent/terrorist propaganda; obscene content that is contrary to law.
- Copyright and intellectual property infringement: Unauthorized distribution of music, films, software, books or images; hosting of or linking to pirated content.
- Resource and usage violations: Use of hosting for purposes other than website hosting; excessive CPU/RAM/traffic usage; cron or limit violations; other prohibitions set out in the Acceptable Use Policy.
When such use is detected or a valid abuse report is received, BurtiNET carries out an investigation and, where necessary, applies measures such as a warning, removal of content, suspension of the account or termination of the agreement.
How to Submit a Report
If you believe you have identified abuse in connection with BurtiNET services, you may submit your report through the following channels:
- E-mail: abuse@burtinet.com (preferred address). For general enquiries, info@burtinet.com may be used.
- Submitting your report in English or Turkish where possible shortens the processing time.
Including the following information in your report helps us carry out a fast and accurate review:
- Type of violation (spam, phishing, copyright infringement, malware, etc.) and a brief description.
- The URL, domain name, IP address or the relevant server/service details concerned.
- Evidence: e-mail headers (for spam), screenshots, a log summary or, for copyright infringement, information showing your ownership of the work.
- Name/title of the complainant and contact details (e-mail and, preferably, telephone).
Copyright infringement reports: Clearly state that you are the owner of the work or its authorized representative, identify the infringed work and specify where it is hosted. The reporting party may be held legally liable for misleading or bad-faith reports.
Review and Action Process
BurtiNET reviews abuse reports within a reasonable period of time. Priority may be given to reports of security threats (malware, phishing, DDoS sources, etc.) and illegal content. During the review:
- The information in the report is verified; where necessary, the relevant account holder (customer) is contacted and their response is obtained.
- If a violation is established, a warning, removal of content, suspension of the account or termination of the agreement may be applied. In the case of serious violations, the account may be suspended or terminated without prior warning; in that case no refund is made.
- The reporting party is informed of the outcome as far as possible, within the limits of confidentiality and legal restrictions. We do not undertake to provide a detailed legal justification or report in response to every notice.
BurtiNET does not disclose customer data to third parties without a legal obligation or a decision of a court or competent authority. Where a violation is established, action against the customer is taken in accordance with the Terms of Service and the Acceptable Use Policy.
Legal Requests and Liability
Court orders or requests from competent authorities: When requests such as the disclosure of personal data, removal of content or blocking of access are received officially and in accordance with legal procedure from the courts of the Republic of Turkey or from legally competent authorities (law enforcement, BTK, etc.), BurtiNET acts within the framework of its legal obligations. A request from a private individual or organization alone, without a court order or legal authority, is not sufficient for the disclosure of customer data or the closure of an account; however, content may be reviewed and action may be taken on the basis of the agreement under the abuse policy.
Misleading or bad-faith reports: It is at BurtiNET’s discretion to take legal action against parties who knowingly submit false abuse reports or misuse the abuse process. Repeated or invalid reports may go unanswered or be blocked.
The account holder (customer) is responsible for the lawfulness of the hosted content and for any intellectual property infringements. As a content host, BurtiNET acts only within the framework of the legislation and the terms of the agreement; this policy does not create any direct obligation to pay compensation.
