Parties

This Distance Sales Agreement (the “Agreement”) is concluded electronically between the parties below under Law No. 6502 on Consumer Protection (“Law No. 6502”) and the Regulation on Distance Contracts (the “Regulation”).

SELLER: BNET Bulut Bilişim LTD. ŞTİ., registered under the name BurtiNET with the Istanbul Trade Registry Office (hereinafter referred to as “BurtiNET”). Registered address: Feyzullah Mah., Bağdat Cad. NEFES PLAZA No:268 Ofis: 206 Maltepe/İSTANBUL. BUYER (CONSUMER): The natural or legal person identified by the identity, address and contact details provided when registering or placing an order through BurtiNET’s website or customer panel (the “Buyer” or the “Consumer”). The Buyer declares that they have read, understood and accepted this Agreement and the preliminary information text on the order screen.

Before placing an order, it is mandatory to confirm the statement “I have read, understood and accept the Distance Sales Agreement and the preliminary information text”; otherwise, the order cannot be completed.

Subject and Scope of the Agreement

The subject of this Agreement is the determination, in accordance with the provisions of Law No. 6502 and the Regulation, of the mutual rights and obligations of the parties regarding the distance sale of the services described below (web hosting, reseller hosting, virtual servers, server housing, domain name registration/renewal, SSL, e-mail and other IT services) ordered by the Buyer electronically through BurtiNET’s website or customer panel.

The distance sales services offered by BurtiNET are also subject to the general terms of use set out in the BurtiNET Terms of Service. The Buyer declares that, together with this Distance Sales Agreement, they have also read and accepted the Terms of Service. The Agreement is deemed to have been concluded between the parties once the order confirmation and payment have been transmitted to BurtiNET.

Preliminary Information and Services Subject to the Agreement

In accordance with the Regulation, the following preliminary information is provided to the Buyer in a clear and comprehensible manner before the distance contract is concluded. The Buyer accepts that they have read and confirmed the preliminary information text presented on the order screen and sent by e-mail.

The Buyer accepts and declares that they have read and confirmed electronically the information regarding the essential characteristics of the service they wish to purchase, the sales price, the payment and delivery terms and the right of withdrawal, and that they then placed the order.

Right of Withdrawal and Exceptions

Pursuant to Law No. 6502 and the Regulation, the consumer has the right to withdraw from distance contracts within 14 (fourteen) days without giving any reason and without paying any penalty. The withdrawal period begins on the date on which the goods are delivered to the consumer or to the person/organization at the address designated by the consumer.

Exception – Services performed instantly in electronic form: Pursuant to Article 15(g) of the Regulation, the consumer cannot exercise the right of withdrawal for services performed instantly in electronic form or delivered instantly to the consumer (for example, IT services such as web hosting, e-mail, virtual servers, domain name registration and SSL certificates) or for services whose performance has begun with the consumer’s explicit consent before the withdrawal period expires.

The hosting, server, domain name and other IT services offered by BurtiNET qualify as services performed instantly, as they are delivered with access details immediately after payment approval. During the order and payment process, the Buyer requests that the service begin immediately by confirming the statement “I agree that I will not exercise my right of withdrawal and that the service will begin before the withdrawal period expires”. Therefore, the right of withdrawal cannot be exercised for these services; the Buyer is deemed to have accepted this.

Where the right of withdrawal can be exercised (for example, in the case of a physical product or another service that is not performed instantly), notice of withdrawal may be given in writing to BurtiNET’s address stated above or by e-mail recorded on a durable medium. The provisions of Law No. 6502 and the Regulation apply to refund requests made within the withdrawal period.

Payment and Delivery

The service fee is collected on the basis of the amount stated at the time of ordering and through the selected payment method. Prices include VAT at the time of ordering. Payment is made in advance by credit card or according to the due date shown in the order; by bank transfer/EFT, it is made within the period specified in the invoice/payment notification.

Delivery: After the payment has been approved by BurtiNET, the access details for the service (username, password, panel address, etc.) are sent to the e-mail address provided by the Buyer in the order/registration. Upon transmission of this information, the service is deemed to have been delivered and performance to have begun. The security of access details and passwords is the Buyer’s responsibility.

BurtiNET reserves the right to change prices and tariffs, subject to prior notice. Existing orders continue on the basis of the term and price specified in the order; current prices may apply in the renewal period. In the event of late payment, the default and suspension provisions of the BurtiNET Terms of Service apply.

Contact, Complaints and Competent Court

For notices and service of process arising from the Agreement, the parties accept the postal and e-mail addresses they provided in the order/registration as their legal domicile and contact address. BurtiNET contact: info@burtinet.com; postal address: BNET Bulut Bilişim LTD. ŞTİ., Feyzullah Mah., Bağdat Cad. NEFES PLAZA No:268 Ofis: 206 Maltepe/İSTANBUL.

Consumer complaints: Under Law No. 6502, the Buyer may submit complaints to BurtiNET; responses are provided within the statutory time limits. The consumer may first apply to the Consumer Arbitration Committees (the relevant contact details can be obtained from the consumer protection legislation and the Ministry of Trade’s web pages) or to the Consumer Courts. In the event of a dispute between the Buyer and BurtiNET, the consumer may apply to the Consumer Arbitration Committees and Consumer Courts at the place of their domicile or at the seller’s place of business.

Without prejudice to Law No. 6502 and the consumer legislation, the Istanbul (Çekmece and Anatolian) Courts and Enforcement Offices have jurisdiction over disputes arising from this Agreement.

BurtiNET reserves the right to make any changes it deems necessary to this Distance Sales Agreement and on the site. The text in force takes effect from the date it is published on the site.
