Scope and General Principles
This Acceptable Use Policy (the “Policy”) is binding on all customers who use the internet and IT services (web hosting, reseller hosting, virtual servers, dedicated servers, domain names, e-mail and related services) provided by BNET Bulut Bilişim LTD. ŞTİ. (hereinafter referred to as “BurtiNET”). It must be read together with the BurtiNET Terms of Service, and this Policy is deemed an integral part of that agreement.
BurtiNET services may be used only for lawful, legitimate and honest purposes. When using the service, the Customer agrees to respect the laws of the Republic of Turkey, internationally accepted standards of use and the rights of third parties. Any use contrary to this Policy constitutes a breach of the Terms of Service and is subject to the sanctions set out below.
The Policy covers everyone who accesses BurtiNET services, including all sub-accounts, reseller customers and third parties using the service. Reseller customers are responsible for ensuring that their own sub-customers comply with this Policy.
Prohibited Content and Activities
Hosting, publishing, distributing or promoting the following content is strictly prohibited. Where detected, the content will be removed and the account may be suspended or terminated.
- Illegal activities: Content that violates the laws of Turkey or of the country in which the service is used; fraud, forgery, money laundering, trade in or promotion of narcotics or other activities harmful to public health.
- Malicious software and security breaches: Distribution of viruses, trojans, ransomware or malware; unauthorized access, phishing, identity-theft sites or tools.
- Copyright and intellectual property infringement: Unauthorized distribution of music, films, software, books, images, etc.; hosting of or linking to pirated content.
- Illegal or harmful content: Content relating to the sexual abuse of children or obscene content (where contrary to law); hate speech, incitement to violence, terrorist propaganda.
- Use for file storage / backup: The hosting service is intended for website hosting; it may not be used as general file storage, archive or backup space. Hosting music, games, programs, films, mp3 or exe files and large archives other than website files, and offering them for mass download, is prohibited.
- Image/video hosting services: Image or video sharing sites on which third parties upload, download or view content in bulk may not be hosted on the servers; the customer is responsible for any such use.
Prohibited activities include being the source of scanning, DDoS or similar attacks, offering proxy or anonymization services (without BurtiNET’s written permission), and operating a botnet or command-and-control server. Where such use is detected, the service will be suspended immediately.
Resource Usage and Technical Limits
Compliance with the following rules is mandatory to ensure fair and secure use of the service. The limits are set out in the package specifications and in the Terms of Service; a summary is provided below.
- Purpose of hosting: The service is intended for website hosting; it may not be used as file storage or backup space.
- Individual file size: On shared hosting, an individual file may be no larger than 500 MB. If the limit is exceeded, a warning is issued and a grace period is granted; if the issue is not corrected, large files may be removed.
- Inode (number of files): The inode limit specified in the package specifications must not be exceeded; monitoring it is the customer’s responsibility.
- Cron: A maximum of 1 cron job per 20 minutes may be run per account. Exceeding this may result in the account being suspended without warning.
- Traffic: If the package traffic quota is exceeded, the service may be suspended until additional traffic is purchased or until the new period begins; unused traffic does not carry over to the following month.
- CPU/RAM: Continuously high resource usage in a shared environment (sustained usage above approximately 35%) may affect other customers; accounts that continuously exceed the limit may be suspended or terminated without warning.
Use that knowingly or continuously exceeds the limits constitutes a breach of the Policy. Where necessary, BurtiNET reserves the right to impose additional limits or restrictions.
E-mail and Communication Rules
The e-mail service is intended for normal correspondence only. The following uses are prohibited:
- Bulk e-mail (spam): Sending unsolicited, bulk or commercial advertising e-mail is strictly prohibited. Where detected, the service will be blocked; in the event of repetition, the account will be cancelled and no refund will be made.
- Mailing / newsletters: Bulk mail or mailing list services are not provided on hosting and reseller accounts; third-party services must be used for this purpose.
- Fake or deceptive sending: Impersonation, phishing or sender names intended to mislead the recipient may not be used.
No 100% guarantee is given for e-mail server availability or delivery; BurtiNET cannot be held liable for outages or delays. If an IP address or server is blacklisted due to spam, the cost of remediation may be charged to the customer who caused it.
Security and Liability
The Customer is responsible for keeping account details and passwords confidential. BurtiNET cannot be held liable for damages arising from unauthorized use or a breach of account security. Passwords must be kept strong and must not be shared with third parties.
Where BurtiNET detects content that is unlawful or contrary to this Policy, it reserves the right to remove the content, block access or suspend/terminate the account without any obligation to give prior notice. Data may be disclosed and access may be restricted where required by law or upon the request of a court or competent authority.
The customer is responsible for the lawfulness and the intellectual property rights of hosted websites, e-mail and other content. Complaints from third parties (copyright infringement, abuse, etc.) may be forwarded to the customer; where necessary, the content will be removed or the account suspended.
Consequences of Violations and Contact
Consequences of violations
Where a breach of the Policy is detected, BurtiNET may, depending on the severity of the situation, issue a warning, remove content, suspend the account or terminate the agreement. In the case of serious violations (spam, malware, illegal content, security attacks, etc.), the account may be suspended or terminated without prior warning; in that case no refund of payments will be made.
Data relating to suspended or terminated accounts may be retained within the limits of legal retention periods and technical capabilities, and may be deleted at the end of that period. The Customer is obliged to back up its own data regularly.
